These Terms govern your access to and use of our Site and services, including reserving roll-off dumpsters, scheduling delivery/pickup, and paying fess through Stripe (collectively, the “Service”). By accessing the Site or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

PRIVACY POLICY

The Company respects the privacy of its Service users. Please refer to the Company’s Privacy Policy (found here: Privacy Policy) which explains how we collect, use, and disclose information that pertains to your privacy. When you access or use the Service, you signify your agreement to the Privacy Policy as well as the Terms of Use.

ABOUT THE SERVICE

Through the Bin Boss Co. website, customers can view available dumpster sizes, check scheduling availability, and request specific delivery and pickup dates. The Site allows users to book rentals securely and complete payments online via Stripe. Customers receive confirmations, invoices, and service updates through email or SMS. Our Site also provides a point of contact for questions, service charges, extensions, or special requests regarding your dumpster rental.

ELIGIBILITY; ACCOUNTS

You must be at least eighteen (18) years of age and legally capable of entering into binding contracts to reserve or use the Service. If account registration is offered, you are solely responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. You agree to notify Bin Boss Co. immediately of any unauthorized access or use of your account. Bin Boss Co. is not liable for any losses, damages, or unauthorized activity arising from your failure to secure your login credentials.

RENTAL PERIODS, PRICING & OVERAGES

Bin Boss Co. offers several rental options based on duration and disposal limits. Standard rental rates are as follows: a three-day rental at $425 and a seven-day rental at $475. Each rental includes delivery, pickup, and disposal of up to two (2) tons of material. If you require additional time beyond the original rental period, extensions, may be granted based on availability at a rate of $25 per additional day. Any disposal weight exceeding the included two tons will incur an overage charge of $60 per ton, as verified by dump scale tickets. Prices and terms may be updated at any time without notice prior to booking, and applicable taxes or municipal fees are added where required.

PAYMENT TERMS; AUTHORIZATIONS

Payment is due at the time of booking via Stripe. You authorize Bin Boss Co. to charge the same payment method for any approved extensions, disposal, overages documented by scale tickets, contamination or special- handling fees, failed pickup/return fees, or any other contract charges. No refunds are issues after delivery. If we arrive and cannot place the dumpster due to access at your site, a trip/return fee may apply.

DELIVERY, PLACEMENT & SITE CONDITIONS

Delivery is to the curbside or driveway unless otherwise agreed in writing. You must ensure safe, level, and unobstructed access for delivery and pickup, including adequate clearance from powerlines, trees, gates, and vehicles. Bin Boss Co. is not responsible for surface damage to driveways, asphalt, curbs, lawns, sprinklers, or underground utilities resulting from normal placement or removal. You are responsible for obtaining any required permits or HOA approvals. Once placed, the dumpster must not be moved by anyone other than Bin Boss Co, as moving it can cause damage and safety hazards.

LOADING RULES; PROHIBITED MATERIALS

Do not fill the dumpster above the rim or exceed legal road weight limits, and keep doors latched and secured for pickup. Prohibited items include, without limitation, tires; batteries; liquids such as paint, oil, and fuel; hazardous, toxic, or medical waste; asbestos; appliances containing freon; wet paint; pressurized tanks; chemicals and solvents; radioactive materials; dirt, concrete, rock, and brick (unless pre-approved as a dedicated load); large mattresses or furniture without prior notice; e-waste where restricted. If contamination or prohibited materials are found, the load may be rejected or returned, and special handling or return fees (minimum $150) and all related costs will be charged to you.

ACCESS FOR PICKUP; FAILED SERVICE

You must provide clear access on the scheduled pickup day. If delivery or pickup fails due to blocked access, overfilled or overweight bins, unsafe conditions, or similar site issues, a $75 return fee (plus actual carrier costs) may be charged.

CANCELLATIONS & RESCHEDULING

Cancellations made at least twenty-four (24) hours before the scheduled delivery are eligible for a full refund. Cancellations made less than twenty-four (24) hours before delivery incur a $75 cancellation fee. After delivery, no refunds are available. Rescheduling is subject to availability and may result in additional fees.

CUSTOMER RESPONSIBILITIES & INDEMNITY

You are responsible for the dumpster and its contents while it is on your site, including losses due to vandalism, fire, theft, or weather exposure. You agree to defend, indemnify, and hold harmless Bin Boss Co., its owners, and employees from and against any claims, damages, liabilities, costs, and expenses arising from your use of the dumpster, your loading practices, your selected placement location, or your failure to comply with those terms.

USE RESTRICTIONS (SITE & SERVICE)

You agree not to misuse the Site or Service, including by scraping or crawling, overloading our systems, posting transmitting or harmful or illegal content, interfering with security features, attempting unauthorized access, or using the Service for any unlawful purpose.

ONLINE CONTENT; THIRD PARTY LINKS

Our Site may contain links to third-party websites and services (such as Stripe & Booquable). We do not control and are not responsible for third-party content, privacy practices, or services. Your use of third-party sites is at your own risk and governed by those parties’ terms and policies.

USER CONTENT (IF APPLICABLE)

If you submit reviews, photos, messages, or other content, you represent that you have the necessary rights to do so and that your submissions are accurate and lawful. You grant Bin Boss Co. a worldwide, non-exclusive, royalty -free license to use, reproduce, display, and distribute such content in connection with the Service.

ELECTRONIC COMMUNICATIONS; CONSENT TO CONTACT

By using the Service, you consent to receive emails and SMS relating to your booking, delivery and pickup status, invoices, and service updates. You may opt out of marketing communications at any time, through operational messages necessary to fulfill your order may still be sent.

WARRANTY DISCLAIMER

THE SITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, TITILE, AND NONINFRINGEMENT. We do not warrant that the Site or Service will be uninterrupted or error-free.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PREMITTED BY LAW, BIN BOSS CO. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, GOODWILL, OR DATA. OUR TOTAL LIABLITY FOR CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE RELEVANT RENTAL.

MODIFICATIONS

We may update these terms at any time by posting a revised version with an updated Effective Date. Your continued use of the Site or Service after any changes become effective constitutes your acceptance of the updated Terms.

GOVERNING LAW; VENUE; TIME TO FILE

The Terms are governed by the laws of the State of Oklahoma and applicable federal law. You agree that the exclusive venue lies in the state or federal courts located in Tulsa County, Oklahoma. Any claim arising from or relating to the Service must be filed within one (1) year after it accrues.

MISCELLANEOUS

If provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. We may assign these Terms; you may not assign them without our prior written consent. No waiver of any term is implied by a failure to enforce it. By booking, paying, or accepting delivery, you acknowledge that you have read and agree to these Terms.
